Terms of Service
Your use of the Moborazzi website and service means that you accept the terms contained herein. Use of the Moborazzi service is defined as including any interaction with the service, site or platform including but not limited to accessing Moborazzi web pages, sending or receiving content and data such as photos and messages via the Moborazzi platform, and viewing and interacting with content on the Moborazzi website. Moborazzi provides its services to users subject to the following Terms of Service (TERMS) which may be updated from time to time at the discretion of Moborazzi or its designees without notice. Failure to use the Moborazzi site and service in accordance with the following Terms may subject you to civil and criminal penalties.
Moborazzi is a content sharing community platform for mobile users. The Moborazzi platform allows users to share content from their mobile phones and computers with other mobile and online users. In a single action users can post photos to the Web and send those same photos to the phones of family, friends, and followers. The service allows users to manage the content they post, and allows those users control over who can view, receive, tag or comment on that content. Moborazzi also serves as a convenient utility to move photos instantly and over-the-air (OTA) from users' phones to their online Moborazzi accounts, where such photos can then be displayed, downloaded, forwarded, or acted upon by the user via their computers. Configurable privacy permissions allow photos to be viewed by all users, restricted to only friends, or configured as private so that such photos can only be viewed or acted upon by those who post them. Disclaimer Moborazzi, its representatives, officers, employees and affiliates (Moborazzi) makes no representations about the suitability or reliability of the service, platform, web pages or content for any purpose or of any kind. The Moborazzi services, website and platform are provided "as is" without warranties of any kind, and provide no warranties or guarantee of content sent to and from the Moborazzi website and platform. Moborazzi hereby disclaims all warranties and conditions with regard to its service, web pages and content including all implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement. In no event shall Moborazzi be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data, revenue or profits, whether in an action of contract, negligence or other tortuous action, arising out of or in connection with use of the service or platform. Moborazzi may make improvements and/or changes in the service, platform or web pages at anytime. Moborazzi does not guarantee that messages will post or post within specified time frames and provides no guarantee against loss of messages, photos or content. Moborazzi does not guarantee that content or files available for download will be free of viruses or other such code that may harm or hinder the operation of computers or devices. Moborazzi does not assume any responsibility nor shall Moborazzi be held liable for corruption or loss of data, photos or other content resulting from the use of its services or websites. Data Plan Charges The Moborazzi service is provided free of charge to users, however users remain subject to data plan charges in accordance with the plans and service agreements in affect with their mobile and/or network providers. Indemnity Use of the Moborazzi service and platform constitutes agreement by such users that they shall defend, indemnify, save and hold Moborazzi and its affiliates, officers and employees harmless from any and all demands, liabilities, losses, privacy violations, costs and claims asserted against Moborazzi, that arise or result from any service provided or performed or content, comments or information posted to or distributed through the Moborazzi service, or by its affiliates, officers or employees. Moborazzi is not liable for photos, content or information posted on it's site or propagated via the Moborazzi platform and servers to users. Users take on all liability regarding the use of the service or for any content posted to it's site or platform. Moborazzi shall have the right to take down posts; block users and or messages; remove tags; remove or edit content, comments or information posted to the Moborazzi service; or remove user accounts at it's sole discretion at any time, for any reason, and without notice. Prohibited Content Pornographic and sexual content is strictly prohibited. Content posted to purposefully or willfully harass or offend individuals, or content related to or used to purposely or willfully circumvent or violate laws within the jurisdiction of the user, Moborazzi, or known laws of other jurisdictions, or content posted in purposeful violation of such laws, is also strictly prohibited. Moborazzi and its designees shall be the sole arbiter of determining whether such content is offensive or abusive and have the right, but not obligation, to remove any content or message that violates these terms or is otherwise objectionable and to suspend, block or remove user accounts from which such content originated at any time and without notice. Users agree not to upload or send to other users or non users via the Moborazzi platform any materials relating to pornography, nudity, obscenity, violations of privacy or proprietary trade information, malicious code, or any harassing or harmful materials as determined by Moborazzi. Moborazzi may involve and cooperate with law enforcement authorities to investigate and or prosecute users who violate these Terms. Conduct Users of the Moborazzi service understand that all information, photos, comments, tags, messages or other data transmitted to and across the Moborazzi platform (collectively referred to as CONTENT) are the sole responsibility of the person from which such content originated. The user–and not Moborazzi or its officers, employees or affiliates–is entirely responsible for all content that he or she uploads, posts, emails or otherwise transmits to and via the Moborazzi service and/or platform. Users acknowledge that Moborazzi does not control or pre-screen content, message postings, or information transmitted to and across its service and, as such, does not guarantee the quality, accuracy or integrity of such content, postings, or information in any way whatsoever. Users understand that by using the Moborazzi service and or platform, they may be exposed to content that is indecent, offensive, or objectionable. Under no circumstances will Moborazzi be liable in any way for any content, including, but not limited to, errors or omissions in any content, or for loss or damage of any kind incurred as a result of the use of any content, message or information posted, emailed or otherwise transmitted via the Moborazzi service. User acknowledges that Moborazzi and its designees shall have the right (but not the obligation) in their sole discretion to refuse or remove any content or message that is posted via the service, or remove any users from the service without notice. Users of the Moborazzi service and platform agree to bear all risks associated with the posting or use of any photos or content including any reliance on the accuracy, completeness, or usefulness of such content. Non Commercial Use Users are hereby granted permission to access the Site solely for personal, non-commercial use. Users agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of, or content contained on or within, the Moborazzi website, service or platform without full written consent and approval by Moborazzi. Non Propiarary Non Confidential The Moborazzi service and website allows users to submit content (including photos), comments and other information for sharing such content and information with other users, or for personal use. Users must not send or post to Moborazzi any information or material that they consider to be confidential or proprietary information, such as business or product ideas concepts, or personal information. Any and all communications and content sent to Moborazzi will not be treated as confidential, proprietary or protected information and users originating such content—not Moborazzi or its officers, employees or affiliates—take full responsibility for violations or breach of confidentiality, proprietary or trademarked information and content. Use of this site grants Moborazzi and its affiliates worldwide, royalty-free, irrevocable non-exclusive, sub licensable and transferable rights and licenses to host, cache, store and archive content submissions; to use, distribute, modify reproduce, adapt, prepare derivative works, compile and publicly or privately display on Moborazzi sites and services or sites and services in connection with Moborazzi or its affiliates content submitted to the service; or use content submitted to the Moborazzi site and service in connection with advertising, promotional or commercial purposes including the right to display, reproduce, and or distribute content and information submitted to the site in any format and or through any media channels. Trademarks and Service Marks Moborazzi, the Moborazzi logo, and any registered trademarks or service marks shown on the Moborazzi website or as part of the Moborazzi service are owned by Moborazzi or other third party owners. No Moborazzi trademark or service mark may be used as a hyper-link without prior and express written consent by Moborazzi or its designees. Unauthorized use of trademarks or service marks is prohibited. Access to the Moborazzi site, service or platform does not imply any grant of rights to use any Moborazzi trademarks or registered trademarks and no licenses or rights to use are granted by implication or otherwise. Users agree to protect and abide by any and all copyrights, patents, trademarks, services marks in relation to the Moborazzi website, service or platform. Restricted Access Moborazzi shall have the right to terminate or block user accounts to restrict access to the Moborazzi service at its sole discretion at any time, for any reason or for no reason, and without notice. |
